Brian Stewart has represented professionals, predominantly in the construction arena, for over 20 years. He enjoys working with these smart, dedicated, and interesting clients. Beyond legal practice, Brian spends free time with his wife and three teenage children as well as being involved in his children's school and sports activities. He and his wife have kept busy restoring their 1911-vintage farmhouse and tending to the property's mature citrus orchard. Brian enjoys hiking and cycling on the weekends in the local San Gabriel Mountains. He has assisted his local community by serving on both the local school board and as President of the Endowment Committee for his children's school.
Prior to beginning the practice of law, Brian received a Bachelor of Arts degree from Western Illinois University where he was selected as a member of the Pi Sigma Alpha Honor Society. He earned the Juris Doctor degree from John Marshall Law School in Chicago, Illinois where he served as President of the Securities and Exchange Law Association and was a member of Delta Theta Phi.
Brian is admitted to practice in the States of California and Illinois, the United States District Court, Central and Eastern Districts of California, and the United States Supreme Court. He is a frequent lecturer to public entities, architectural and engineering firms, and other professional organizations. Brian is a member of the American Board of Trial Advocates (ABOTA), the American Bar Association, and the Association of Southern California Defense Counsel. He has also served as Trustee of the Los Angeles County Bar Association and President of the Pasadena Bar Association (editing the Pasadena Bar Bulletin for four years).
As an affiliate member of the American Institute of Architects (AIA) in the Los Angeles and San Fernando Valley Chapters, Brian served on the most recent AIA California Council (AIACC) ADAPT Handbook Update Committee, and currently serves as the attorney representative on AIACC's Legislative Affairs Committee. In addition, he previously served on the AIA Los Angeles Chapter (AIALA) Political Outreach Committee. Brian is a member of the American Council of Engineering Companies of California (ACEC California, formerly the Consulting Engineers and Land Surveyors of California known as CELSOC) where he currently serves on both the Legislative Committee and on the Business Management and Insurance Committee.
Brian's reported appellate decisions include Paz v. State of California (2000) 22 Cal.4th 550 (private contractor's liability for conditions of public property), Greshko v. County of Los Angeles (1987) 194 Cal.App.3d 822 (good faith settlement), Markborough California, Inc. v. Superior Court (1991) 227 Cal.App.3d 705 (contractual limitation of liability), and Hansen Mechanical, Inc. v. Superior Court (1995) 40 Cal.App.4th 722 (express indemnity). In addition, Brian acted as amicus counsel in McCarthy v. Teng Li (4th Civ.No. G030544) on behalf of the National Society of Professional Engineers (NSPE), the Structural Engineers Association of California (SEAOC), and the California Society of Professional Engineers (CSPE) concerning application of the economic loss doctrine to design professionals in construction disputes.
